Trademark Policy for ISNails ®️

ISNails is officially registered as a trademark in Switzerland. License number: 823737, registration date: December 9, 2024. The trademark covers the following categories under the Nice Classification of Goods and Services:

Class 3: Cosmetic products, including gel polishes, nail care products, bonders, primers, and other materials for the nail industry.
Class 8: Tools for manicure and pedicure, including files, brushes, and professional equipment.
Class 44: Services in the nail industry, such as training, workshops, and advanced qualification courses.

ISNails' Rights under International Law

The registration of ISNails as a trademark grants its owner exclusive rights to use the name and associated branding elements. Under international trademark protection laws, any unauthorized use, copying, or imitation of the ISNails trademark, including logos, branding, product names, and concepts, constitutes a violation of the owner's rights.

Companies or individuals attempting to infringe these rights may face the following consequences:

Legal Claims: Injunctions to prohibit the use of the trademark.
Financial Penalties: Compensation for damages caused by unauthorized use.
Criminal Liability: Depending on the jurisdiction and the nature of the infringement.

We are committed to defending ISNails' trademark rights in any region, including countries that are signatories to the Madrid Agreement on the International Registration of Marks.

1. General Provisions
1.1. These Terms & Conditions constitute a legally binding agreement between "ISNails - Art Nails - Iryna Abelman," a sole proprietorship registered in Switzerland at 1196 Gland (hereinafter "Seller"), and any individual or entity (hereinafter "Buyer") purchasing goods through the ISNails online store (hereinafter "Website").
1.2. By placing an order on the Website, the Buyer agrees to these Terms & Conditions.
1.3. The Seller reserves the right to amend these Terms & Conditions without prior notice. Any amendments will not affect orders already confirmed by the Buyer.

2. Subject of the Agreemen
2.1. The Seller agrees to transfer, and the Buyer agrees to accept and pay for, the goods ordered through the Website in accordance with the terms outlined in this agreement.

3. Payment Terms
3.1. Payment is made via bank transfer/payment cards/PayPal/Twint. Full prepayment is required for all buyers.
3.2. Payment terms for wholesale buyers are negotiable. Prepayment or payment in installments may be agreed upon based on the order amount.
3.3. Invoices will be issued by the Seller via email after order confirmation.

4. Delivery Terms
4.1. Delivery is available across Switzerland, the UK, EU, and EU+ countries.
4.2. Shipping costs are calculated separately based on the weight of the order and the delivery destination.
4.3. The Buyer is responsible for covering any customs duties and taxes for deliveries to the UK, EU, and EU+ countries.
4.4. Delivery times depend on the Buyer’s location and the selected courier service.

5. Return and Exchange Policy
5.1. Returns are not accepted after the goods have been received.
5.2. If the goods are damaged or lose their commercial appearance during delivery, the Buyer must notify the Seller within 24 hours of receipt. The Buyer is required to send a video recording, description of the issue, and a list of damaged items via email to: contact@irinasternbeauty.com.

5.3. If the Seller confirms the damage, the damaged goods will be replaced at the Seller's expense.

6. Prices and Discounts
6.1. Prices listed on the Website are fixed but may vary depending on the volume of the order.
6.2. The Seller reserves the right to adjust prices without prior notice; however, these changes do not apply to already confirmed orders.

7. Limitation of Liability
7.1. The Seller is not liable for:
- Indirect losses, including lost profits, data loss, or damage to the Buyer’s business reputation as a result of using the goods or being unable to use them.
- Delivery delays or performance failures caused by third parties (such as courier services or customs authorities).
- Any discrepancies between the Buyer's expectations of the product and the actual characteristics or appearance of the goods, provided the goods meet the technical standards.

8. Intellectual Property Rights
8.1. All materials on the Website, including but not limited to photographs, product descriptions, and trademarks, are the property of the Seller and are protected by copyright. Unauthorized use of these materials is prohibited and will be prosecuted under applicable law.
8.2. The Buyer may not use the ISNails brand for promotional or advertising purposes without prior written consent from the Seller.

9. Force Majeure
9.1. The Seller is not liable for delays or non-performance due to circumstances beyond the Seller’s control (force majeure), including but not limited to natural disasters, pandemics, military conflicts, governmental decisions, transport disruptions, accidents, or cyber-attacks.
9.2. In the event of force majeure, the Seller’s obligations may be temporarily suspended, with the possibility of extending deadlines or terminating the agreement if the force majeure event lasts longer than 60 days.

10. Warranty Terms
10.1. The Seller provides a 12-month warranty on all products from the date of purchase.
10.2. The warranty covers manufacturing defects and damage caused by improper packaging or transportation.
10.3. The warranty does not apply if the damage is due to improper storage or usage by the Buyer, mechanical damage, or the use of expired products.

11. Dispute Resolution
11.1. All disputes and disagreements arising in connection with the performance of this agreement shall be settled through negotiations.
11.2. If the parties cannot reach an agreement, the dispute shall be referred to the arbitration court in Switzerland, in accordance with Swiss law.

12. Final Provisions
12.1. These Terms & Conditions take effect once the Buyer accepts them by placing an order on the Website.
12.2. The Seller is not responsible for actions of third parties involved in the delivery of goods.
